General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions apply to all contracts concluded by a customer ("Consumer" in the sense of Art. 205 OR) with TM Müller Trade, based in Ferrachstrasse 34, 8630 Rüti ZH, Switzerland (hereinafter referred to as "Provider"), via the website [www.safeclub.ch]. Deviating customer conditions are not recognized unless the Provider expressly agrees to their validity in writing.
2. Conclusion of Contract
The product presentation on the website does not constitute a legally binding offer, but rather a non-binding invitation to place an order. By clicking the "Buy" button, the customer submits a binding purchase offer. The contract is concluded as soon as the Provider confirms the order by email ("Order Confirmation").
3. Prices and Payment Terms
- All prices are stated in Swiss Francs (CHF) and include the statutory value-added tax (VAT).
- Shipping costs will be shown separately before the order process is completed.
- Payment can be made via ShopPay, PayPal, VISA, MasterCard, Union Pay, or advance payment.
- In case of delayed payment, the Provider reserves the right to charge default interest according to Art. 104 OR.
4. Delivery and Shipping
- Delivery will be made within the period specified in the product description or, if no period is specified, within a reasonable time.
- The Provider generally only delivers within Switzerland and to Liechtenstein.
- The risk passes to the customer as soon as the goods have been handed over to the transport company (Art. 185 OR).
5. Retention of Title
The delivered goods remain the property of the Provider until full payment of the purchase price.
6. Warranty and Liability
- The Provider is liable for defects in the goods in accordance with the legal provisions of the OR (Art. 197 et seq.).
- In case of defective delivery, the customer can demand subsequent performance (repair or replacement delivery). If this is impossible or unreasonable, the customer is entitled to withdraw from the contract or to a price reduction.
- The statutory limitation period is two years from delivery (Art. 210 OR).
- The Provider's liability for slight negligence is excluded, as far as legally permissible.
7. Right of Withdrawal (Right of Return)
Consumers in the sense of Art. 205 OR are granted a 14-day right of withdrawal. Details can be found in our separate withdrawal policy.
8. Data Protection
Personal data is collected, processed, and used exclusively within the framework of applicable data protection laws (in particular the revFADP – revised Data Protection Act). For details, please refer to our privacy policy.
9. Applicable Law and Jurisdiction
- All contractual relationships are governed exclusively by Swiss law.
- The exclusive place of jurisdiction for all disputes arising from this contractual relationship is the Provider's registered office, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.
- In relation to consumers, the following applies: The place of jurisdiction is the customer's domicile or the Provider's domicile in accordance with mandatory provisions of Swiss Private International Law (IPRG).
10. Severability Clause
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. An effective provision that comes closest to the economic purpose of the invalid provision shall replace the invalid provision.
